These Terms of Service (“Terms”) govern your use of myCostBase (the “Service”). By creating an account or using the Service, you agree to these Terms.
If you use myCostBase on behalf of another person, household, or organization, you confirm you have authority to do so.
1. Service scope
myCostBase provides software for recording, reviewing, reconciling, and exporting adjusted cost base and capital gains information for Canadian taxable investment accounts.
myCostBase helps you organize and calculate the ledger, but you remain responsible for the completeness and accuracy of the source records you provide.
2. Eligibility
You must be able to form a legally binding contract to use myCostBase. If you’re using the Service on behalf of a household member, client, or organization, you confirm you’re authorized to act for them and to enter into these Terms on their behalf.
3. Accounts and security
You are responsible for:
- keeping account credentials and API keys secure;
- rotating keys if exposed;
- limiting access to authorized users;
- reviewing imported and manual data for accuracy;
- activity under your account.
If you suspect unauthorized access, contact us promptly through our contact page.
4. Imported and third-party records
If you import broker CSVs, issuer tax records, or other third-party data:
- you confirm you have rights to use and upload that data;
- you remain responsible for validating imported values;
- you understand broker or tax-slip values may differ from legal ACB requirements.
We may restrict usage patterns that create security, abuse, or operational risk.
5. Acceptable use
You agree not to use myCostBase to:
- violate laws or regulations;
- upload deceptive, harmful, or malicious content;
- bypass plan, rate, or security controls;
- interfere with operation of the Service.
We may suspend access for violations.
6. Intellectual property
myCostBase owns the Service, including its software, design, and branding. These Terms don’t transfer any of that to you — you get a limited, non-exclusive right to use the Service for your own recordkeeping while your account is active.
You own the data you enter or import (your tax owners, transactions, securities, and notes). You can export it at any time from within the Service, and you’re free to do whatever you like with your own exported data.
7. Not tax, legal, or financial advice
myCostBase is a calculation and recordkeeping tool. It is not tax, legal, accounting, or financial advice, and using it does not create a professional relationship of any kind. You’re responsible for reviewing the figures it produces and for confirming your filing positions with a qualified accountant or tax professional before you rely on them.
8. Plans and limits
- Plan limits are enforced per billing period and may include feature, usage, and owner limits.
- Upgrades may apply immediately. Downgrades usually apply at the next billing cycle.
- Taxes may apply based on jurisdiction.
9. Billing, Payment, and Refund Policy
If you subscribe to a paid plan:
- Fees: Prices are listed on our website and may change with notice.
- Payment: Payments are processed by Stripe. By paying, you agree to Stripe’s terms and privacy policy.
- Billing: Plans are billed annually in advance and renew automatically unless canceled.
- Refunds: Payments are non-refundable once a billing period starts, except where required by applicable law (for example, a billing error or duplicate charge). Use the Free plan to evaluate myCostBase with your own data before upgrading — there’s no trial period or credit card required for it.
- Cancellation: You may cancel anytime. Access continues until the end of the billing period you already paid for. Amounts already paid are not refunded.
- Failed payments: We may suspend access until any outstanding balance is resolved.
10. Suspension and termination
We may suspend or terminate access if:
- you violate these Terms;
- your usage creates legal, security, or operational risk;
- required fees remain unpaid.
You may cancel at any time. Cancellation takes effect according to your current billing cycle.
11. Privacy
Your use of myCostBase is governed by our Privacy Policy.
12. Service changes
We may add, modify, or discontinue features. We will post updates when material changes affect use of the Service.
13. Disclaimers
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, or that every imported record, adjustment, or report output is correct by default.
14. Indemnification
You agree to indemnify and hold myCostBase harmless from claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, the data you upload or enter, or your violation of these Terms.
15. Limitation of liability
To the maximum extent permitted by law, myCostBase is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability arising from these Terms or your use of the Service is limited to the fees you paid us in the 12 months before the claim arose.
16. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. If a disagreement comes up, we’ll try to resolve it informally first by contacting each other directly. If that doesn’t work, any dispute will be handled by the courts of Ontario.
17. General provisions
If any part of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn’t a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
18. Changes to these Terms
We may update these Terms from time to time. Continued use after changes become effective means you accept the updated Terms.
