These Terms of Service (“Terms”) govern your use of myCostBase (the “Service”). By creating an account or using the Service, you agree to these Terms.
If you use myCostBase on behalf of another person, household, or organization, you confirm you have authority to do so.
1. Use of the Service
myCostBase is software for tracking and organizing adjusted cost base and capital gains records.
You must use the Service lawfully and only for legitimate account and recordkeeping purposes.
2. Account responsibility
myCostBase is intended for adult use. By creating an account, you confirm you are an adult.
You are responsible for:
- keeping your account credentials secure;
- limiting access to authorized users;
- checking imported or entered data for accuracy;
- all activity under your account.
If you suspect unauthorized access, contact us promptly through our contact page.
3. Your data and imports
You are responsible for the data you upload, import, or enter.
If you import third-party records, you confirm you have the right to use that data and that you will validate it before relying on outputs.
4. Billing and refunds
Paid plans are billed in advance and may renew automatically unless canceled.
Payments are handled by third-party payment providers. We do not control those providers’ terms.
Unless required by law, fees are non-refundable once a billing period starts. You can cancel anytime, and access continues until the end of the paid period.
5. No professional advice
The Service is for informational and recordkeeping purposes only.
It is not legal, tax, accounting, or financial advice. You are responsible for your own filings and decisions.
6. Acceptable use
You agree not to:
- break laws or regulations;
- upload harmful or malicious content;
- bypass security, billing, or usage controls;
- interfere with Service operations.
We may suspend or terminate access for violations or security risk.
7. Service availability and changes
The Service is provided on an “as is” and “as available” basis. We may add, change, or remove features at any time.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.
Our total liability for claims related to the Service is limited to the amount you paid us in the 12 months before the claim.
9. Indemnification
You agree to defend and indemnify myCostBase against claims, damages, and reasonable legal costs arising from your data, your misuse of the Service, or your violation of these Terms.
10. Intellectual property
The Service and its content are owned by myCostBase or its licensors.
You keep ownership of the data you enter. You can export your data at any time while you have an active paid subscription. If you are on the Free plan and need a copy of your data, contact us and we will help you get it.
11. Privacy
Your use of myCostBase is governed by our Privacy Policy.
12. Governing law
In short: these Terms are interpreted under Ontario law.
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.
13. Changes to these Terms
We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.
